Terms of Service

Thank you for using our products and services (the “Service/s”). By becoming a member or using our Services, you accept and agree to these Terms and Conditions (“Terms”). Therefore, it is important that you carefully read through these Terms. If you do not agree to these Terms, you should not register with Assure Tech LLC and shall discontinue your use of the Service.

Using Our Services

To use our Services, you must follow some simple rules. The Service is only available for your private, personal use and is not intended for commercial use, business operation, or public display. Do not misuse the Services in any way that may harm Assure Tech LLC, our partners, or any third party. You may only use the Services as permitted by applicable laws and these Terms. By using our Services, you agree that:

  • All of the personal data and information provided by you are accurate, complete, and up to date.
  • You are solely responsible for all activities conducted under your account and all content uploaded, generated, or stored through your D-ScreenMate account (“User Material”), including uploaded test images, scan records, and interpretation results.
  • Assure Tech LLC does not actively monitor all User Material generated on the Service, but may at any time, at its sole discretion, review, remove, or restrict User Material from the Service and/or your user account, and may suspend or terminate your account and membership without prior notice.
  • Your membership, including your registered email address and login credentials, is personal to you and may not be transferred, shared, lent, or used by any other individual or entity. You are solely responsible for securely storing your login details and maintaining account security. Assure Tech LLC is not liable for any loss or damage caused by unauthorized account access, credential leakage, or improper account use. If you discover or suspect any unauthorized use of your account, you must immediately contact our customer support.
  • The Service is not intended for use by persons under the age of 13. To register for and use D-ScreenMate, you must be at least 13 years of age and legally capable of entering into this agreement under local applicable laws.
  • Any violation of these Terms may result in immediate termination of your user account, membership access, and active subscriptions. If your account is terminated due to a violation of these Terms, you are not eligible for any refund of prepaid subscription fees.
  • You may not conduct any commercial activities, advertising, paid promotion, or direct third-party commercial activities through our Services.
  • You may not publish, transmit, or spread propaganda, religious or political opinions, or any content involving racial hatred, illegal pornography, violent information, or illegal and harmful content through the Service. You may not defame, harass, insult, threaten, or infringe the legal rights and reputation of other users or third parties through the Service.
  • You may not upload, transmit, or distribute any malicious files, viruses, trojans, malware, or program code that may damage the normal operation of the Service, the equipment of Assure Tech LLC, or the devices and property of third parties.
  • You may not collect, share, disclose, or disseminate any other users’ personal information without obtaining explicit prior consent from the relevant individual.

Your Account

You may cancel and terminate your account at any time within the D-ScreenMate mobile application or through the official website account deletion function. Please note that simply uninstalling the mobile application will not automatically terminate or cancel your paid subscription. You must actively cancel your subscription through the corresponding application store platform where you completed the payment, including Apple App Store, Google Play Store, or any other authorized third-party payment channels. All subscription cancellation rules shall follow the terms and rules of the corresponding platform. You may refer to the in-app guidelines for specific account and subscription cancellation procedures.

Drug & Test Result Interpretation Disclaimer

You acknowledge and agree that you are fully responsible for your personal judgment and behavioral decisions related to drug and substance testing. Assure Tech LLC is not a medical institution, inspection institution, or law enforcement agency. The D-ScreenMate Service only provides intelligent scanning, identification, and auxiliary interpretation of drug and substance test strip results for personal reference only. All Service content, including scan results, data analysis, and intelligent interpretation, is for auxiliary and reference purposes only, and does not constitute medical identification, judicial identification, professional diagnosis, or authoritative test conclusion.

All test results generated by the Service cannot replace professional manual identification, laboratory testing, or official authoritative certification. We do not guarantee the absolute accuracy, completeness, authenticity, or applicability of scan recognition results and data analysis content. You shall not use the Service results as the sole basis for medical judgment, legal judgment, or any important personal decision. If you have doubts about test results or related conditions, please consult a professional testing institution or relevant authoritative department in a timely manner.

Assure Tech LLC shall not be liable for any direct or indirect losses, risks, or liabilities arising from user reliance on Service results, improper use of the Service, or misjudgment of test information.

Premium Subscription Services

This clause applies to all users who purchase or subscribe to D-ScreenMate Premium and other paid functional services. After paying the corresponding subscription fee, you obtain the right to use Premium exclusive functions during the valid subscription period, subject to these Terms. All Premium subscriptions are prepaid. You may terminate your membership at any time, and your Premium access will remain valid until the expiration of the currently paid subscription period.

Subscriptions are automatically renewed unless you turn off the auto-renew function at least 24 hours before the end of the current billing cycle. Subscriptions purchased through Apple App Store, Google Play Store, or any other third-party in-app payment channels can only be cancelled through the official management entrance of the corresponding platform.

Subscription fee pricing is displayed in the D-ScreenMate application and on the official website www.drugscreenmate.com. We support multiple payment methods including Apple In-App Purchase, Google Play In-App Purchase, Stripe, PayPal and credit card payment. Special additional terms may apply to individual payment channels. Assure Tech LLC reserves the right to adjust subscription fees and preferential rules at any time.

You authorize us to deduct fees automatically upon your successful subscription. In accordance with applicable EEA and German consumer protection rules, if you do not start using the paid Service within 14 days after subscription confirmation, you have the right to withdraw from the subscription contract. To exercise the withdrawal right, please send an email to support@drugscreenmate.com. All eligible prepaid fees will be refunded within 30 working days. All payments completed through Apple official channels shall follow Apple’s refund rules, and refunds shall be processed solely by Apple in accordance with its policies. Failure to pay subscription fees shall not be deemed automatic termination of the Premium subscription agreement.

Intellectual Property

All intellectual property rights of the Service, including but not limited to trademarks, service marks, trade names, logos, software codes, interface designs, text content, algorithm models, and all copyrighted content within the application, are exclusively owned by Assure Tech LLC or its authorized third-party partners.

You may only use the above intellectual property resources for your personal use of the Service. Any reproduction, modification, secondary development, commercial use, public dissemination, or unauthorized authorization to third parties is strictly prohibited without our prior written consent, unless otherwise required by mandatory applicable laws.

By uploading or submitting User Material to our Service, you warrant that you own the complete legal intellectual property rights of the submitted content. You hereby grant Assure Tech LLC a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, process, display, and optimize User Material solely for the purpose of operating, maintaining, and iterating the Service. This license remains effective until you or we delete the corresponding User Material in accordance with these Terms.

Disclaimer and Limitation of Liability

You use the Service entirely at your own risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will operate continuously, without interruption, completely error-free, or fully secure at all times. We are not responsible for any errors, omissions, or inaccuracies in Service data, software functions, third-party content, or User Material.

All third-party links, third-party service references, and third-party SDK services involved in the Service are provided without explicit or implicit warranty. We do not assume joint and several liability for third-party service quality, data security, and content compliance.

To the fullest extent permitted by applicable laws, Assure Tech LLC shall not be liable for any indirect, incidental, consequential, special, or exemplary damages. Except for intentional misconduct or gross negligence, our total aggregate liability for all direct losses arising from Service use shall be limited to the lowest of the following: (i) the total subscription fees you have paid; (ii) the subscription fees you paid in the previous calendar year; or (iii) 1000 US dollars.

Miscellaneous

We are not obligated to fully monitor all User Material generated by users. Users may view public content shared by other users on the Service. We reserve the right to evaluate and remove inappropriate, illegal, or harmful content at our sole discretion.

You may not assign, transfer, or entrust your rights and obligations under these Terms to any third party without our prior written consent. Assure Tech LLC reserves the right to assign and transfer its rights and obligations under these Terms in whole or in part.

We reserve the right to refuse service provision to any user at any time for legitimate reasons. We may revise and update these Terms from time to time in accordance with business iteration and legal requirement changes. The latest version will be posted on the official website www.drugscreenmate.com. Material changes that affect users’ core rights will take effect after your confirmation and continued use of the Service. Your continued use of the Service after the update release constitutes your acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms and your use of the D-ScreenMate Service are governed by the laws of the State of Delaware, United States, excluding conflict of law rules. For users located in Germany and the European Economic Area (EEA), these Terms shall comply with GDPR and German Federal Data Protection Act (BDSG) mandatory provisions. All disputes arising out of or related to these Terms and the Service shall be subject to the exclusive jurisdiction of the competent courts of Delaware, United States.
